Rising of the Court

The Rising of the Court is a traditional sentence which is used in less than 3 % of criminal cases in NSW and the shortest possible period of custody.

It is a sentence whereby the Judge deems that your attendence at Court is sufficient as punishment for your offence, “the restraint on the offender’s liberty in the courtroom from the moment the sentence is passed is regarded as equivalent to being held in prison”.¬†This restraint occurs only until the Court is adjourned, which usually occurs almost immediately following sentencing.
