The Local Court will determine the outcome of an appeal – whether the suspension is varied or revoked. Whilst considering an application, the courts do not take into account the circumstances surrounding the driver being charged.

In most instances the following suspensions can be appealed:

  • RTA suspension of licence for exceeding the speed limit by 30km/h or 45km/h
  • Immediate suspension of licence by a police officer for offences including: mid range PCA, high range PCA, driving in a dangerous manner, speeding, street racing, etc
  • P plater has licence suspended by RTA for exceeding demerit points
  • You CANNOT appeal a Licence Suspension for demerit point loss if you have a full licence

It’s important to understand that an Appeal must be lodged no later than 28 days from when the driver is charged.
